Matthew Berliner represents clients in complex business, commercial, employment and intellectual property disputes. His range of experience includes the litigation of unfair competition claims in various industries, trade secret disputes, commercial disputes, partnership/LLC disputes, consumer/employment class actions, wrongful death and personal injury cases, and labor and employment matters. He also provides businesses with advice and counseling regarding their trademarks, patents, and other intellectual property rights. This includes IP litigation in state and federal courts.

Throughout his career, Matthew has represented a wide range of clients including Fortune 500 companies, retailers, business partnerships and enterprises, media companies, credit reporting agencies, internet companies, land developers, entrepreneurs, state and federal agencies, and private individuals involved in a myriad of businesses and ventures. Matthew has represented clients in arbitrations and other alternative dispute resolution forums, and has taken many matters to trial in state and federal courts.

Prior to joining Fortis LLP as a Partner, Matthew had practiced law for seven years in national and international law firms.  Matthew’s prior affiliations had included working as an associate with the large international firm of Jones Day and thereafter was a founding partner at a small litigation boutique firm prior to his becoming a Partner at Fortis LLP.

Representative Matters

Savy Investments, LLC, et al. v. Chaudhary, et al. - Complex litigation representing investors in an alleged Ponzi scheme in lawsuit brought by “net-losers” seeking to claw-back profits made by Defendants.  Pre-trial lead counsel and co-lead trial counsel during month long trial in Orange County Superior Court - complex division. Complete defense verdict in favor of clients on million dollar claim brought by the Plaintiffs. 

O’Boyle, et al. v. O’Boyle -  Represented Defendant/Respondent in fraud and elder abuse lawsuit/arbitration brought by his brother and sister seeking in excess of $550,000 in damages from financial dealings with parties’ mother. Complete defense verdict of all Plaintiffs’ claims after a week-long AAA arbitration.

Denny v. Cha – Represented Plaintiff in adverse possession lawsuit brought in Los Angeles Superior Court. Successfully obtained verdict in client’s favor as to title of real property after court trial.

Hill v. Grand Circle, LLC - Represented Plaintiff in catastrophic personal injury action against American based tour operator emanating from bus crash in Egypt in 2010.  Settled matter days before trial with favorable terms for client.

Mitchell v. 3PL Systems Inc., - Lead counsel for Defendant 3 PL Systems, Inc. in action brought by disgruntled co-owner and officer of the company claiming that he (personally) owned the company’s software.  Obtained Summary Judgment in favor of client as to all of the Plaintiff’s affirmative claims for copyright infringement and unfair competition and subsequently tried client’s cross claims for copyright infringement/breach of fiduciary duty. Client was awarded multi-million dollar verdict in its favor.

Domestic Violence Restraining Order – Represented high-level executive of publically traded internet/tech company in action brought by ex-wife.  Obtained dismissal of action by opposing party after multi-day trial when perjured testimony by opposing party and her family was demonstrated.

Hall v. Time, Inc. 158 Cal.App.4th 466 (2008). Part of team that successfully obtained dismissal of class action false advertising and unfair competition lawsuit. Subsequently, the California
SMD Capital Management, Inc. v. Aleck International Holdings, Inc. – Represented Defendant and one of its principals individually in a breach of contract action regarding the sale of a business. Obtained favorable settlement on behalf of clients after asserting counterclaims and exposing fraud by Plaintiff.

Rag Place, Inc., v. Los Angeles Rag House - Represented Plaintiff in trademark infringement and unfair competition action in Federal District Court. Obtained favorable settlement for client a few weeks before trial.

Matthew is a member of the Orange County Bar Association, the Association of Business Trial Lawyers, and the American Intellectual Property Law Association (AILPA). Matthew was identified on the Los Angeles Times Magazine annual list of “Superlawyers—Rising Stars” for over five years.
